Reasonableness of Arbitration Clauses in Employment Contracts in Sweden

Arbitration clauses in employment contracts are widely accepted in Sweden. The most important legal basis for a court to void an arbitration clause in an employment contract is section 36 of the Swedish Contracts Act which allows the court to set aside an unreasonable contract term. In the assessment of whether an arbitration clause is unreasonable, Swedish courts are to take into consideration among other things the right to a fair trial according to article 6 of the ECHR. In October 2018 the ECtHR issued a widely debated judgment in the Mutu and Pechstein v. Switzerland case. The ECtHR found that a professional German speed skater’s right to a fair trial was infringed by an arbitration clause that directed all disputes to the Court of Arbitration of Sports (CAS) in Switzerland. This judgment gives rise to the question, what is a reasonable arbitration clause in an employment contract in Sweden. Does the recent case law development from ECtHR have any relevance for Swedish employment arbitration law and its liberal attitude towards arbitration clauses? These and other issues are addressed in the seminar.

Sören Öman, tidigare före­ståndare för Stockholm Centre for Commercial Law, och Kerstin Ahlberg, före­ståndare för Institutet för social civilrätt, har en gemen­sam arbets­rättslig seminarie­serie vid Juridiska fakulteten på Stockholms universitet. Samman­lagt 29 seminarier med totalt 2053 del­tagare har genom­förts sedan serien började 2013.

Sören Öman är ord­förande i Arbets­domstolen. Han är också skilje­man, före­läsare och för­fattare. Han har lång er­faren­het från ar­bete i Regerings­kansliet och om­fattande erfaren­het av ut­red­ningar inom olika juridiska om­råden, såsom arbets­rätt och data­skydd.
