The role of micro, small and medium sized companies is often pointed out as the way forward for the economy. Such companies often form clusters or production or supply chains under a larger company. The micro, small and medium sized companies out of necessity often co-operate or even share knowledge and resources. In such a company network context several legal issues arise.

In Italy, there is special legislation on contractual networks (”contratto di rete”) whereby two or more firms undertake the obligation to exercise in common one or more economic activities in order to increase and gain in innovativeness and competitiveness within the market, while in Sweden general rules apply in the company network context.

The legal issues concern both commercial law and more traditional labour law and also raises the question of protection of fundamental rights.
